The “Approval Scheme”, which is the new work permit adjudication that was implemented on November 28th imposes further labor market testing for employers sponsoring work permits for non-EU nationals, with at least three advertisements in the main recognized press. The scheme also requires that further documentation including police clearance certificates for the employer. Approvals will only be issued to employers who have paid taxes for the last quarter and who have no labor compliance convictions and who have not had any employment related sanctions in the past three years.

Employers who do not comply with the new requirement could face fines between 150-4500 Euros, closing of their premises, refusal to benefit for state allowances.

Intra-company transfers and European Blue Card permits, professional athletes and cross-border employees will be exempt from the labor market testing requirement.
